Terms of Service
Working draft. These terms describe how Monte Climb works today and are being reviewed by a lawyer. They do not yet include the legal name and address of the business or the governing-law and dispute terms, which will be added, along with any other changes from that review, before Monte Climb takes payments.
The short version
- Monte Climb is planning software. It is not investment, tax or legal advice, and William is an AI, not a licensed adviser.
- Projections are estimates built on assumptions and simulated markets. Real results will differ.
- The trial is $1 for 7 days. Unless you cancel before it ends, it renews at $140 a year until you cancel.
- Cancel anytime by emailing info@monteclimb.com.
1. These terms
These terms are an agreement between you and Monte Climb (“we”, “us”) [legal name and address to be added] for your use of the Monte Climb website and app (the “Service”). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the Service.
2. What Monte Climb is, and is not
Monte Climb is software for planning your own retirement. It takes the facts you give it, runs them through simulated market futures and tax calculations, and shows the results. It is for your information and education.
- Not advice. Monte Climb does not give investment, tax, legal or insurance advice and does not recommend buying, selling or holding any security. We are not a registered investment adviser, broker-dealer, tax preparer or law firm, and no fiduciary or advisory relationship is created by your use of the Service.
- Estimates, not promises. Every projection depends on your inputs and on assumptions about returns, inflation, taxes, longevity and the law, which will not turn out exactly as modeled. Success rates describe simulated futures, not guarantees.
- Not a tax return. Tax figures, including the 1040 worksheet, are planning estimates. Don’t file from them; use your actual tax documents and, where needed, a tax professional.
- You decide. Decisions about your money are yours. For decisions with real consequences, talk to a licensed professional.
3. William, our AI guide
William is an AI built on Anthropic’s Claude. The figures he quotes come from Monte Climb’s own engine, but like any AI he can misunderstand a question or be wrong, so check anything important. William can suggest a change to your plan; it is made only when you confirm it. William never moves money, places trades or contacts anyone on your behalf. You agree not to use William to produce harmful or unlawful content, and the usage policies of our AI provider also apply to what you ask him.
4. Your account
You must be at least 18 and live in the United States to use Monte Climb. Keep your sign-in secure and give us accurate information; the Service is only as good as the facts it is given. An account is for one person and their own household’s planning.
5. Trial, subscription, renewal and cancellation
- Trial. The trial costs $1 and gives you full access for 7 days.
- Automatic renewal. Unless you cancel before the trial ends, your subscription renews automatically at $140 per year. The card you entered is charged $140 when the trial ends and $140 every year after that, until you cancel. Prices are in US dollars, plus any sales tax that applies.
- How to cancel. Email info@monteclimb.com; the link opens a cancellation email that’s ready to send. We will confirm by email. Cancelling stops the next renewal. If you cancel during the trial, you won’t be charged the $140. If you cancel later, you keep access until the end of the year you paid for.
- Reminders. We will email you before each yearly renewal.
- Price changes. If the yearly price changes, we will tell you at least 30 days before a renewal at the new price, and you can cancel before it applies.
- Refunds. The $1 trial fee is not refunded. If a renewal charge surprises you, email us within 14 days of the charge and we will refund it. (This refund policy is part of the draft under review.)
- Payments are processed by Stripe. We never see or store your full card number.
6. Your information
Your plan and the information you give us remain yours. You allow us to store and process it to provide the Service, as described in our Privacy Policy, and you can ask us to delete it at any time.
7. Using the Service fairly
You agree not to break the law with the Service; access anyone else’s account or data; interfere with, overload or probe the Service’s security; copy, scrape, resell or build a competing product from the Service; or reverse engineer it except where the law allows. We may limit how much the Service, including William, can be used in a day to keep it running fairly for everyone.
8. Other companies’ services
Some features rely on other companies: Plaid for bank connections, Stripe for payments, Google for sign-in, Anthropic for William. Their own terms and privacy policies apply to what they do, and we are not responsible for their services.
9. Our software and content
Monte Climb, including its software, engine, designs and written content, belongs to us. While your account is active, we give you a personal, non-transferable right to use it for your own planning.
10. Changes
We may improve or change the Service. When we change these terms, we will post the new version here with a new version number and date; if a change is significant, we will tell you by email or in the app before it takes effect.
11. Ending your account
You can stop using Monte Climb at any time and ask us to delete your account. We may suspend or close an account that breaks these terms or puts the Service or other people at risk, and will tell you why when we can.
12. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, including that its projections or tax estimates are accurate or complete, or that it will always be available or free of errors.
13. Limits on liability
To the extent the law allows, we are not liable for investment losses, tax consequences or other results of decisions you make, or for indirect, incidental or consequential damages, and our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
